General conditions

We have the following terms and conditions

  1. General

1.1 In these terms and conditions, 'skin therapist' means the article 34 BIG registered skin therapist(s) | all employees of Parisa skin & laser clinics | located at Jan Steenstraat 7A, 1506 LN in Zaandam. The skin therapists are members of the Dutch Association of Skin Therapists (NVH) and work according to the professional code of the NVH. The skin therapists are also registered in the Dutch Quality Register Paramedics.

1.2 In these conditions, "client" means the person who orders the skin therapist to provide treatment.

1.3 In these terms and conditions, "client" also means his/her legal representative.

1.4 These conditions are part of every agreement between the client and the skin therapist.

1.5 These conditions shall also apply in the event the skin therapist engages third parties for the execution of the order.

1.6 A medical treatment agreement (ex Book 7, Title 7, Section 5 of the Dutch Civil Code) between the skin therapist and the client is also subject to the Medical Treatment Agreement Act (WGBO).

1.7 The effect of Article 7:404 and Article 7:407 paragraph 2 of the Civil Code is expressly excluded.

  1. Agreement

2.1 The agreement between the skin therapist and the client involves the client's order to the skin therapist for treatment, medical or otherwise.

2.2 The skin therapist has the right not to comply with an unreasonable desire of the client and may refuse to perform treatment.

3.Consent

3.1 The client gives consent to the skin therapist prior to the performance of treatment.

3.2 The skin therapist may require the client to confirm consent in writing.

3.3 The client's consent also includes the skin therapist's authority to engage auxiliary persons and to accept any limitation of liability of auxiliary persons on behalf of the patient. The skin therapist is not liable for the choice of the auxiliary person and for any shortcomings of this auxiliary person, except in the case of intention or conscious recklessness of the skin therapist.

3.4 In the event the client refuses or withdraws consent, the skin therapist shall not (no longer) provide treatment.

3.5 In the case of a minor (under 18 years of age), the parent/guardian/legal representative must provide written consent prior to commencement of initial treatment.

  1. Information and capture

4.1 The client shall inform and keep the skin therapist informed of all information necessary for the proper execution of the agreement.

  1. Rates and health insurance

5.1 During the intake interview, a price agreement is made for the treatment. This will include the area to be treated and the length of time.

5.2 Parisa skin & laser clinics offers one-time intake consultation free of charge.

5.3 The price agreement made is per treatment or applies to a package or spa price.

5.4 The skin therapist reserves the right to deviate from the price agreement made if the duration or the area to be treated is changed. This will then be discussed with the client prior to the treatment.

5.5 Rates, unless expressly agreed otherwise in writing, are for the duration of the calendar year and may be adjusted annually.

5.6 It is the client's responsibility to ensure that he is aware of whether and to what extent his insurer will reimburse the treatment. Furthermore, it is the client's responsibility to declare invoices to his or her insurer or not.

  1. Payment

6.1 The client receives the invoice immediately after the treatment and must pay it at the same time in cash or by debit card.

6.2 Regardless of whether the invoice is reimbursed by the insurer, the client shall at all times remain liable for full and timely payment of the invoice.

6.3 The client is responsible for submitting and settling invoices with health insurance companies. Parisa skin & laser clinics is not responsible for changes in rights regarding reimbursements and policy conditions. In case of questions, the client should contact the health insurance company.

6.4 In the event that the client does not pay the invoice in time and/or in full, the client is in default. The skin therapist is then entitled to charge the client statutory interest on the invoice amount or the remainder thereof. The skin therapist is also entitled to take collection measures. The costs associated with collection (including extrajudicial costs and other costs) shall be borne by the client.

6.5 In the event of late payment, the skin therapist is authorized to suspend further treatment or to provide it only against cash payment, unless the amount of the late payment, the need for skin therapy treatment or urgency precludes this.

6.6 The obligation to pay shall not be suspended by the client making a complaint against the skin therapist about the invoice and/or treatment, unless the skin therapist agrees to the suspension of the obligation to pay.

6.7 The payment obligation does not lapse if the client terminates the agreement or requests the skin therapist to transfer the treatment to another person.

  1. Cancellation

7.1 In the event the client is unable to attend an appointment, he must cancel it with the skin therapist no later than one working day or twenty-four hours in advance.

7.2 If the client does not cancel or does not cancel on time, Parisa skin & laser clinics is obliged to charge the costs of the treatment. These costs amount to € 1,- per reserved minute of treatment time.

7.3 Appointments may be cancelled by the client and/or contact person by telephone or e-mail message (only at info@delaserkliniek.nl). The cancellation is registered by Parisa skin & laser clinics at the time the client calls or the client's e-mail message is received by the skin therapist (see also the contact information at www.delaserkliniek.nl).

  1. Liability

8.1 Parisa skin & laser clinics' liability, both for direct and consequential damages and to the extent covered by its liability insurance, shall be limited to the amount of the payment made by the insurer.

8.2 If in any case the insurer does not pay, or the damage is not covered by the insurance, the liability of Parisa skin & laser clinics is limited to the amount of the invoice.

8.3 Rights to compensation for liability expire after 1 year after the harmful event has occurred.

8.4 Parisa skin & laser clinics is not responsible for damages arising from the client's failure to provide complete and/or truthful information regarding the client's general health regarding conditions that may affect treatment.

8.5 Parisa skin & laser clinics cannot predict the exact number of treatments a person will need and cannot be held liable for them. The employees of Parisa skin & laser clinics can only indicate the average number of treatments.

8.6 If a (laser) treatment does not work or if the condition (such as excessive hair and rosacea) returns after some time, Parisa skin & laser clinics is not responsible and liable for this. Parisa skin & laser clinics offers no guarantees on any treatment.

  1. Complaints

9.1 In the event of dissatisfaction or a complaint by the client regarding treatment by the skin therapist, the client shall report this to Parisa skin & laser clinics as soon as possible. The skin therapist and the client shall then both make every effort to reach a solution.

9.2 As a member of the NVH, Parisa skin & laser clinics will, in the event of a complaint, receive support from the mandatory complaints officer and are affiliated with a dispute resolution system.

9.3 If a solution proves impossible, the client may apply to the internal complaints committee of the Dutch Society of Skin Therapists: the Patients' Advisory Committee ('PAC'). This committee will mediate between the skin therapist and the client.

9.4 If mediation by the PAC does not lead to a solution, the client may apply to the National Paramedics Primary Care Complaints Committee.

  1. Nullity

In the event that any provision of these terms and conditions is void or voidable, this shall not affect the validity of the remaining provisions.

  1. Applicable law

The agreement concluded between the skin therapist and the client, and any further agreements concluded in execution thereof, shall be governed exclusively by Dutch law.

  1. Changes

12.1 The skin therapist reserves the right to modify these conditions at any time.
